These Terms of Service (“Terms”) govern your access to and use of www.partsisland.com, the PARTS ISLAND online store, and related products and services (collectively, the “Services”). By visiting the site, creating an account, or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.

1. About PARTS ISLAND

PARTS ISLAND is an independent reseller of automotive parts, accessories, tools, and related products. Unless a product page expressly states otherwise based on documented authorization, PARTS ISLAND is not the manufacturer of the product and is not sponsored by, endorsed by, or affiliated with the vehicle or component manufacturers referenced on the site.

Manufacturer names, vehicle names, model names, part numbers, and other marks may be used only to identify the intended application, compatibility, or source of a product. All third-party trademarks remain the property of their respective owners.

2. Eligibility and Account Responsibility

You must be at least the age of majority where you live, or use the Services under the supervision of a parent or legal guardian. You are responsible for keeping account credentials confidential and for all activity under your account. Information you provide must be current, complete, and accurate.

3. Product Information and Independent Verification

We work to provide useful product descriptions, specifications, images, measurements, application references, and compatibility information. Supplier revisions, packaging changes, display settings, production tolerances, and data errors can cause differences. Images may show installation context or optional items that are not included; the written product page and selected variant control.

Vehicle fitment tools, tire and wheel selectors, part-number references, and application notes are informational aids. Before ordering or installing a part, compare the listing with the vehicle year, make, model, trim, engine, drivetrain, measurements, connector, mounting points, and any relevant identification number. Contact us before purchase if fitment is uncertain.

Do not rely on a disclaimer to resolve a listing inconsistency. If a title, image, description, specification, or fitment statement conflicts, contact us so we can investigate before you purchase or install the item.

4. Orders, Pricing, and Payment

Submitting an order is an offer to purchase. We may accept, reject, limit, or cancel an order for a lawful reason, including inventory or supplier unavailability, suspected fraud, payment problems, pricing or catalog errors, shipping restrictions, or an inability to verify order details. An automated order confirmation acknowledges receipt and does not by itself constitute final acceptance.

Prices, promotions, taxes, and availability may change before an order is accepted. If we cancel a paid order or a paid portion of an order, we will issue the applicable refund to the payment method used, subject to payment-provider processing times. You authorize us and our payment providers to charge the amounts shown at checkout.

5. Shipping, Delivery, Returns, and Refunds

Shipping and delivery are governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy. Those policies are incorporated into these Terms. Delivery estimates are estimates unless applicable law requires otherwise. Review the applicable policies before ordering.

6. Installation, Use, and Safety

Automotive products can affect vehicle safety and performance. Follow the product instructions, vehicle service information, warnings, torque specifications, and applicable laws. Installation, diagnosis, coding, programming, balancing, alignment, or calibration should be performed by a qualified professional whenever the product or application requires it.

Stop using a product and seek qualified assistance if it appears damaged, does not fit as expected, triggers a warning, interferes with safe operation, or may have been installed incorrectly. Do not modify or use a product in a manner not described by the manufacturer or listing.

7. Third-Party Products, Services, and Links

Some products are supplied or fulfilled by independent suppliers. The site may also use or link to services operated by Shopify, payment processors, carriers, tracking providers, manufacturers, and other third parties. Their separate terms and privacy practices may apply. A link or compatibility reference does not by itself mean that PARTS ISLAND or the third party sponsors or endorses the other.

8. Intellectual Property

The PARTS ISLAND name, site design, store-authored text, and other content created for the store are protected by applicable law. Other content is owned by, licensed to, or used with permission by its respective rights holder. You may use the site for personal shopping and product research, but you may not reproduce, scrape, republish, or commercially exploit protected site content without permission or another lawful basis.

Third-party marks are used for identification and compatibility purposes. Concerns about copyright, trademark, or other intellectual-property rights should be submitted under our Copyright & Intellectual Property Policy.

9. Reviews, Feedback, and Submissions

If you submit a review, photo, comment, or other content, you represent that you have the right to submit it and that it is not unlawful, misleading, defamatory, harmful, or infringing. You grant PARTS ISLAND a non-exclusive, worldwide, royalty-free license to host, reproduce, format, and display that content in connection with the Services and store promotion. You retain any ownership rights you otherwise have.

We may moderate or remove submissions that violate these Terms, applicable law, or the rights of others.

10. Prohibited Uses

You may not use the Services to violate law or third-party rights; submit fraudulent orders or false information; interfere with site security or operation; introduce malicious code; harvest personal data; evade access controls; abuse promotions, returns, or payment systems; or use automated means to extract site content in a manner that burdens the Services or violates applicable law.

11. Privacy

Our collection and use of personal information are described in our Privacy Policy. Shopify and other service providers may process information as described there.

12. Warranty Disclosures

Any written warranty included with a product or expressly stated on its product page applies according to its terms. Except for those express commitments and to the extent permitted by law, the Services and site content are provided on an “as available” basis. We do not promise uninterrupted site operation or that every catalog field will be free from error.

Nothing in these Terms excludes, limits, or changes a warranty, remedy, or consumer right that cannot lawfully be excluded, limited, or changed.

13. Limitation of Liability

To the extent permitted by law, PARTS ISLAND will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from use of the Services or a product, including lost profits, lost data, loss of use, or business interruption. Where liability cannot be excluded, our aggregate liability arising from a particular product or transaction will not exceed the amount paid for that product or transaction, except where a higher amount or different remedy is required by law.

These limitations do not apply to liability that applicable law does not permit us to limit, including any non-waivable consumer rights.

14. Indemnification

To the extent permitted by law, you agree to indemnify PARTS ISLAND against third-party claims, losses, and reasonable costs caused by your unlawful use of the Services, your material breach of these Terms, or content you submit that violates another person’s rights. This section does not require indemnification for conduct caused by PARTS ISLAND.

15. Suspension and Termination

We may restrict or terminate access to the Services when reasonably necessary to address fraud, abuse, security risks, unlawful conduct, or a material violation of these Terms. Obligations that by their nature should survive termination will survive.

16. Changes to the Services or Terms

We may update the Services and these Terms. The current version and update date will be posted on this page. Changes apply prospectively when posted unless applicable law requires a different notice or effective date. Material changes will not retroactively reduce rights for an order already accepted unless permitted by law.

17. Governing Law

These Terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law rules. This choice does not deprive a consumer of mandatory protections available under the law of the consumer’s residence.

18. Severability and Entire Agreement

If a provision is unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will remain effective. These Terms and the policies incorporated by reference form the agreement governing use of the Services and purchases from PARTS ISLAND, except for any additional written terms that apply to a specific transaction.
